Legal Notice and Terms of Use

1. Identification of the owner

Talent360Show, its website and its application are owned by TALENT360HUB LLC, a Bulgarian company that operates the Talent360Show brand, with its registered and tax address at 10 Stefan Verkovich, Plovdiv 4000 (Bulgaria) and registration number EIK/VAT BG208378160. Our head office is at the European Trade Center, Building D, 1F, 115 M Tsarigradsko Shose Blvd., Sofia 1784 (Bulgaria), and our Western Europe office at Nevelgaarde 8, 3436 ZZ Nieuwegein (Netherlands). 2. Purpose and acceptance

Talent360Show is a web application for creating interactive presentations, courses, quizzes and games. Browsing the public website means accepting this legal notice as published at the time. Creating an account or using the application also means accepting these terms of use. If you do not agree with them, please do not use the site or create an account.

If you use Talent360Show on behalf of an organisation, you confirm that you are able to accept these terms on its behalf. If you are acting as a consumer, nothing in them limits the rights the law gives you.

3. The service and your account

• You must be at least 16 years old, or the minimum age set by the law of your country if that is higher, to create an account.
• The information you give us must be true and kept up to date.
• You are responsible for keeping your password safe and for whatever is done with your account. If you think someone is using it without your permission, change your password and let us know.
• Teams: the holder of a Pro plan can invite other people to their team. The owner pays for the plan and controls the team space; projects in that space belong to the team and stay with its owner even if a member leaves or deletes their account. As owner, you are responsible for whom you invite and for the content processed in the team space.

4. Plans and payment

• Free: one project and no AI features.
• Pro: paid, with several tiers and priced by number of users. Prices and what each tier includes are published on the website. If you pay annually, you get two months free compared with paying monthly. You can also buy AI credit packs, as a one-off payment, and extra storage, which is added to your subscription.

How you pay: by card or other payment methods through Stripe or, in Latin America and other markets where it is available, through dLocal Go; or by bank transfer, if we offer it to you. Payment is made on the gateway's secure page: we never see or store your card details. When you take out a subscription, you authorise renewals to be charged to the same payment method.

• Renewal: Pro subscriptions renew automatically at the end of each period, monthly or annual, and each new period is charged to the same payment method until you cancel them. If a renewal payment fails, you keep the plan for a few days while it is retried, and you can pay it or change the payment method from your account Settings; if it remains unpaid, the subscription is cancelled and your account moves to the Free plan. If you pay by bank transfer, there is no automatic charge: we tell you how to pay for each period.
• Cancellation: you can cancel at any time from your account Settings or by writing to privacy@talent360hub.com. Cancellation takes effect at the end of the period already paid for, and your account then moves to the Free plan. We do not refund periods that have already started, except where the law requires it.
• Right of withdrawal: if you are a consumer in the EU, the EEA or the UK, you may withdraw from the contract within 14 calendar days of signing up, without giving any reason, by writing to privacy@talent360hub.com. If you expressly asked to start using the paid plan within that period, on withdrawal you pay only the proportion of the service already provided (Article 14(3) of Directive 2011/83/EU). We refund you using the same means of payment within 14 days at most.
• Businesses and professionals: if you sign up for the purposes of your trade, business or profession, you have no right of withdrawal.
• Price changes: we announce them in advance and they apply from the next period; if you do not agree, you can cancel beforehand.
• Taxes: published prices exclude taxes. Depending on your country, taxes may apply; if so, they are added to the price and you will see the total amount on the payment page before you confirm.
• Invoices: we issue an invoice for every payment and send it to you by email.

5. Your content

What you create and upload to Talent360Show remains yours. So that we can provide the service, you grant us a free, non-exclusive and limited licence to host your content, process it (including the AI features you switch on), display it to the people you share it with, and make backups. The licence lasts for as long as the content is on the service and, for backups, until they are deleted.

You warrant that you hold the necessary rights over what you upload and embed (images, audio, video, trademarks and other people's data), and you are responsible for what you share publicly. As regards any personal data it contains, we act as your processor on the terms set out in the Privacy Policy.

6. Acceptable use

You may not use Talent360Show to:

• publish or share content that is unlawful or infringes other people's rights, including intellectual property, image or data protection rights;
• distribute malware or spam, or harass other people;
• share any sexual content involving children;
• attempt to access other people's accounts or restricted areas, or get round your plan's limits;
• make bulk or automated use of the service.

If you come across content on Talent360Show that you believe is unlawful or breaches these terms, write to privacy@talent360hub.com with the link and the reason. We will review it and reply to you.

7. Gallery templates

You may use and modify the templates in the public gallery in your own projects, including to share or present them. You may not resell or redistribute them as templates, either individually or in collections. The templates remain ours or our licensors'.

8. Content generated by artificial intelligence

The results of the AI features are generated automatically and may contain errors, inaccuracies or out-of-date information. Review them before using them: you are responsible for how you use them. They do not constitute professional advice of any kind. What data is sent to the AI provider is explained in the Privacy Policy.

9. Sharing and embedding

• A project shared by public link can be seen by anyone who has the link. You can protect it with a password.
• If you embed a project in another website, anyone visiting that website will see it, and that website's own terms and privacy policy will also apply.
• Uploaded files have addresses that cannot be guessed, but anyone who has the direct link to a file can see it even if the project is private.
• You are responsible for whom you share your content with, especially if children will see it.

10. Suspension and termination

We may suspend or close accounts that breach these terms or the law, giving notice beforehand where possible. You may stop using Talent360Show whenever you like and ask us to delete your account as explained in the Privacy Policy. When the account is deleted, your content is deleted within the periods stated there.

11. Intellectual and industrial property

The software, designs, text, logos, the Talent360Show brand, templates and databases of the platform belong to TALENT360HUB LLC or its licensors and are protected by intellectual and industrial property law. You may use them within the service and in accordance with these terms, but you may not reproduce, distribute, adapt or communicate them publicly outside it without written authorisation. Third-party trademarks and names that appear belong to their owners and are mentioned for identification purposes only.

12. Third-party links and content

The site and presentations may include links to and content from third parties, such as YouTube or Vimeo videos, pages, HTML code or animations embedded by users. We do not control or choose that content: the user who embeds it does. We are not responsible for its content, its privacy practices or its availability, and linking to it does not mean we endorse it. Following an external link places you under the terms of the destination.

13. Availability of the service

We aim to keep Talent360Show continuously available, but we do not guarantee it. We may interrupt, modify or withdraw it in whole or in part for technical reasons, for maintenance or because we reorganise the service. We recommend exporting to PDF any projects you cannot afford to lose.

14. Limitation of liability

To the extent permitted by applicable law, we are not liable for damage arising from being unable to use the service, from content published by users or third parties, from the use made of AI results, or from viruses or other harmful elements introduced by third parties. None of the above limits liabilities that the law does not allow to be excluded, nor any rights you may have as a consumer.

15. Data protection and cookies

How we process personal data is explained in the Privacy Policy, and our use of cookies and browser storage in the Cookie Policy. Both form part of this legal notice and are to be read alongside it.

16. Governing law and jurisdiction

This legal notice and these terms are governed by Bulgarian law and by the applicable law of the European Union, in particular the General Data Protection Regulation. Any dispute falls to the courts of Sofia (Bulgaria), without prejudice to your right, if you are acting as a consumer, to bring proceedings in the courts where you live and to keep the protection their law gives you, where the law grants you that right.

17. Changes to this document

We may amend this document to reflect changes in the law or in the service. When we do, we will update the date and version shown at the top and publish the new text on this same page. If a change materially affects your rights or obligations as a registered user, we will tell you beforehand in the application or by email.

18. Versions in other languages

This document is published in English, Spanish, French, German, Portuguese, Italian and Catalan so that you can read it in your own language. Translations are offered as a courtesy and, in the event of any discrepancy between versions, the English version prevails.
